Case Results

  • Wynn McGarry successfully represented a recruiting firm in a breach of contract dispute against a large pharmaceutical company. Ray McGarry tried the case and obtained an award on behalf of our client and against the pharmaceutical company. The pharmaceutical company was represented by Morgan Lewis & Bockius.
  • Wynn McGarry successfully defended an international specialty metals company in a breach of contract action brought by one of its suppliers. The matter was tried before an arbitrator appointed by the American Arbitration Association pursuant to the terms of an arbitration clause in the contract between the parties. After three days of arbitration, an award was issued in favor of our client.
  • Wynn McGarry successfully defended a federal court action brought against one if our clients alleging breach of the Family Medical Leave Act. Our attorneys, led by Matt Wynn and Ray McGarry successfully had the case dismissed on the basis that the claim was barred based upon the inconsistent testimony of the plaintiff in an earlier workers' compensation matter brought by the same plaintiff.
  • Wynn McGarry successfully defended a Workers' Compensation Penalty Petition on behalf of a large employer where the petition alleged that the employer had taken an "illegal" credit for salary continuation benefits paid to Claimant.
  • Wynn McGarry, led by Ray McGarry, successfully defended a premises liability action in the Court of Common Pleas, Philadelphia County, on behalf of a large Philadelphia employer by asserting the "Exclusive Remedy Doctrine" of the Workers' Compensation Act. In that same action, we successfully defended a second defendant by proving that they owed no duty to maintain the premises.
  • Wynn McGarry successfully prosecuted a Termination Petition on behalf of a large corporation in Northeast Philadelphia leading to a sizable reimbursement from the Supersedeas Fund.
  • Wynn McGarry, led by Harsinie Panditaratne secured a Workers' Compensation Modification/Suspension Petition in a case in which claimant had sustained a 2004 lumbar spine injury for which she was receiving active treatment. The Judge not only suspended the Claimant's benefits, but granted Supersedeas.
